    Just wanted to post my experience with SMART Parking and the Sports Direct car Park in Darlington after recieving a 'Parking Charge Notice' from them also. I appealed and was rejected so I filed an appeal with POPLA and low and behold SMART parking withdrew their claim 2 weeks later. I had a very strong case; the Parking Charge Notice was full of holes, the signage was not what they claimed it was and they would not provide a copy of the contract with the land owner. I used MoneySavingExpert (thread 5229730) and parkingcowboys.co.uk to great effect. I now park in the multi-story across the street- it's cheaper. Let us know how things turn out. Henry

    Hi, Sorry I forgot to update my case - I read the stickies, I researched the other posts (lots of them) and I listened to the advice given. I took on board advice from 'Guys Dad' and 'HooHoo' and amended my first draft of appeal to include valid contract and Non compliant NTKs. I received a letter back 2 weeks later:

    The Operator has informed us that they have cancelled parking charge notice number XXXXXXXXXx, issued in respect of a vehicle with the registration mark XXXX XXX .

    Your appeal has therefore been allowed by order of the Lead Adjudicator.
    You are not liable for the parking charge and, where appropriate, any amounts already paid in respect of this parking charge notice will be refunded by the Operator.

    I suspect, as with 'akaindie', it was the lack of valid contract that did it.

    Thank you very much for all help,I read the newbies thread and copied and pasted the document and submitted to Smart Parking.
    I have since received an e-mail saying that the charge was cancelled.

  • Well done Rob - it's very dodgy the Darlo Sports Direct one - i'm not sure how they get away with it. They obviously don't have any contractual rights to pursue claims.

    PPCs say its carpark management, BPA say its raising standards..... we all know its just about raking in the revenue. :eek:
