Parking eye / court case defended

Hello
Does anyone know how much the costs are once a claim goes to court
I have defended online and got documents back stating its going to court and a reply to my defence from parking eye
I have also got a small claims track form to fill in
Parking eye have filled there's in and state they don't want to go to mediation service
What happens now does the case get heard without me ?
How much are the cost?
Is it worth trying parking eye and getting the costs reduced and pay the fine and costs?
The legal jargon is really hard to get to grips with and I have enough stress without this added extra
All advice. Help appreciated

Download and read the Parking Prankster's guides to defending a ParkingEye court claim: http://www.parking-prankster.com/court-claim.html

There will be a hearing, and if you don't turn up for it and defend yourself you will lose. I hope you requested that the case be transferred to the County Court nearest to your home! The current best advice is to request the judge to stay the case until judgment has been handed down in the ParkingEye vs. Beavis case at the Supreme Court.

Costs are strictly limited on the Small Claims Track. ParkingEye has already added £50 for solicitor's fees, which is the maximum, they can't add any more (and if you are up for it you can challenge the £50 because it's a lie: their process is automated - the forms are spewed out by a machine - and the solicitors who sign the forms are in-house staff, so there's no way they've paid anyone £50 for anything). If/when it does get to court have your own costs schedule ready so you can request a costs award if you win (you might be able to get around £100).

If you want to avoid the court case the Prankster's guides contain advice on haggling with PE. It costs them a lot of money every time a case goes all the way to court so they have been known to settle for a lot less than they originally demanded.

as this is going to court, learn the legal jargon and drop the word "fine" from your vocabulary !!

its not a fine , its a speculative invoice

in your defence, ask for mediation by ADR at popla, if the judge grants it then you have still got a form of ADR

also ask the case be stayed for the Beavis outcome too

dont assume it automatically goes all the way , read post #5 of the newbies sticky thread, get and read the parking prankster court guides

learn more about it, dont use words like "fine" that are incorrect, try to look professional, like you know what it all really means

    good luck

even at this stage its still possible for the landowner to cancel, in whos car park was it in?

either which way you could go for some publicity in the local press/ media focusing on the fact that the landowner or retailer (through their agents parking eye) took you to court causing you a great deal of worry/stress/anxiety/loss of earnings/time etc. if the judgement goes in your favour which it should if you prep well and right then that would be even more ammunition to fire at the landowner you could even say the landowner could be liable to refund motorists who paid parking eye.

concentrate on the court, but also try going for a landowner cancelation, despite what may be said the landowner can still call of Miss Rachel Ledson and co at parking eye.

Thank you for your advice and help

the car park houses aldi, pound shop and a couple of more shops.
this happened a few months ago and according to their documentation was 10 minutes over the allocated time.
  • Courts a hoot. The Judge's seem quite nice, and even the Parking Eye lawyer was showing us pictures of her baby.

The worse case scenario seems to be £179, although in our case, the lawyer said she would try and recoup her costs also. (it was a 4 hour case.) I think they have to demonstrate that you have been unreasonable though.

I'm not an expert on legal process, (but it turned out, they weren't either.)
