I have received an invoice from my car hire company,Hertz,telling me they have paid a "parking fine' issued on 19.05.2015.at Woodfields Retail Park,Bury.I believe the company is called 'Parking Eye'
Hertz issued this notice to me on 18.6.2015.
I have just received the letter here in Queensland, 2days ago on 7.07.2015.
It is for 50pounds fine amount and 42 pounds admin.
Can I still appeal this charge,after this time delay?
I have read some of the other posts regarding this thread,
so should I use one of the templates mentioned,and what one?

no , you cannot appeal the charge as Hertz paid it, same as in this thread you posted in

as RK, they have paid it instead of naming the hirer
you can dispute it with Hertz due to them not following the BVRLA guidelines , because if they wish to pay it as RK then they have shouldered the alleged debt and denied you your right of appeal
so your dispute is now with Hertz and their wording of contracts (because this is an invoice, not a fine , not a penalty)
it may also be a matter of dispute with your bank, claiming that any money extracted by Hertz is an unauthorised payment because you were given no opportunity to dispute it or appeal
so no you cannot appeal to PE or popla, because the keeper has paid it
there is no chance of PE refunding any money either, they got what they wanted leaving you to argue it with hertz, same as that other thread and dozens of similar threads on here about hire companies and charging hirers instead of naming hirers which they should have done
your dispute is now with Hertz over legal arguments and contract laws, its no longer about a parking invoice , that has been settled by Hertz to PE0 -

All will now depend on the wording of your contract with Hertz. Can they pay charges without referring them to you, or not?
By the way, as ParkingEye boast in court that they cancel 60% of challenged invoices it is more than likely they would have cancelled your when challenged.Dedicated to driving up standards in parking0 -

If the terms are the same in your rental agreement then, IMO, you should tell your card company that this is an unauthorised payment and you want your money back.
A speculative invoice from a private company is not covered by anything listed in 14.1, and 14.2 is utterly fatal to them: they were never required to pay anything, all they needed to do was to pass on your details and they'd have been done with it.
This is basically a tacit conspiracy between the parking companies and the hire companies: the parking companies get their £100 or whatever, and the hire company gets to rip you off for a ridiculous "admin charge".
In the UK the card company will squirm and try to get out of it, I'm guessing it's the same in Australia. Be firm and don't take no for an answer.Je suis Charlie.0 -

I will contact Hertz and my credit card company,and push them to
refund the monies.

Have two replies from Hertz to say ,the parking invoice is
within their T and C's,so don't know where to go with it now,maybe
nowhere.
The credit card company Virgin,are also saying it is within the hire companies conditions,and they don't think it is refundable.
A real pain.

It might be worth trying the BVRLA dipute resolution service. Hertz are members and have been told they should not pay these invoices.

Ok thanks for that,I've had another reply from Hertz
general manager,who just fobbed me off the terms and conditions again.
I'll try BVRLA ,and see if that gets any joy..
