Ignored Armtrac & now TNC are chasing me

Hi,
I received a ticket from Armtrac security for parking in a private spot (it was an office that was vacant and my husband had parked up there to have a nosey and then had a wonder around the area and returned to find a ticket).
We didn't panic over this because a few years ago we'd received a ticket from Armtrac security for overstaying for a few minutes at the maritime museum in falmouth and the advice at the time was to ignore. Hence why this time we did the same, we ignored the notice- threw it away and have since ignored their letters (addressed to me the registered keeper). However I have now found that we shouldn't have done that
Anyway I have only found this out because today I have received a letter from TNC Parking Services which is all written in Red, Headed; Urgent attention required. Attention! Unpaid Parking Enforcement Notice. They said that "the notice has not been paid and Armtrac Services has now instructed us to make recovery". They say I have 14 days to settle or challenge the the parking notice.
My question is do I start with the template PCN letter on the Newbies thread even though this has now been passed to a recovery services. Does it still apply? And should I wait a couple of weeks as you suggested (20 days) or will this escalate in this time)
I apologise if this has already been covered in a different thread but I can only see threads on TNC from people who were unaware of a ticket in the first place and not from people who have ignored it like us!
Many thanks in advance!

Ignore was the wrong thing to do, but now you have presumably lost the opportunity to appeal (you don't say how long ago you got this) you are left with ignoring them now and waiting to see if they issue a court claim.
If you do get a court claim then read up in the newbies forum on how to defend it.0 -
Ok thanks, it was from February 2015.
There is an appeals form on the TNC website- but you say it's not worth filling this out now as I've ignored it for too long?
I'll keep my fingers crossed that I don't get a court summons then. I wish the car was in my husband's name grr!0 -

too late to appeal at the moment , yes
you had 28 days from the NTK to appeal as keeper , once that has passed they wont give you an appeal code, there is no obligation to do so after 28 days
they have 6 years to pursue you, hence the debt collector letters, possibly a court case (MCOL) for this unpaid invoice
ignore the debt collectors, but never ignore real court papers (if it ever happens)
if it did, you can then try to get them or the judge to apply ADR by some means or other, but as its IPC and IAS its a waste of time so better taking a chance at court where you can defend yourself
so probably a waste of time anyway, unless it goes to court
read the NEWBIES thread again, learn what you need to know from it0 -
court summons
Really? Let's not over-egg the pudding and put the frighteners on OPs. That's what PPCs and their lapdog debt collectors do! We should be well above that, especially when using throwaway remarks like this.
Who's summoning who here?
Why not throw in 'prosecution', 'penalty', 'offence', and 'fine' for good measure?
@ OP - take it easy, get back if you need further reassurance about this. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

mmmm , missed that little nugget0

February Armtrac were still under the BPA. They don't do court often. TNC have been calling some ignorers in the Falmouth/Penryn area. You may as well sit tight now. Remember its a private company and they have no statutory authority.0

Thanks for the advice all. Will just sit tight now then and definitely learnt my lesson not to ignore in future!0

Hi,
Is there any other update on this thread I'm in all most the same boat with this company.

Hi,
Is there any other update on this thread I'm in all most the same boat with this company.
Ben
Sadly, many posters never return to update us. This thread is 7 months old (and considered 'ancient' in the context of the rapid turnover of threads here).
Please read the NEWBIES FAQ sticky near the top of the forum thread list, one page back from here, which will provide you with information on how to fight any private parking ticket. Please start a new thread of your own after reading the sticky (it's not a 'quick scan job) if you have any questions. Please note, we are not a legal advice forum.
