Warranty issue advice

Hi please help. posted on behalf of a friend do I have a case or not ..I bought a double door fridge 18months ago for about £350-£400, from a dealer who sold it as a product from the manufacture but had some cosmetic damage (had a minor dent on the side panel). A week ago the fridge side stopped working, I contacted an independent engineer who basically told me to get rid as it was not worth repairing and he advised that the product was previously reconditioned and it's just didn't have cosmetic damage only .Got back in touch with the shop where I got it and they basically said its out of warrant (had 12 months warrant). They offered to arrange for an engineer to come and diagnose the problem and I will have to pay £40 call out charges for engineer plus any extra charges for the repairs. Spoke to customer services today and they have advised me to write to them as I feel the product was mis- sold to myself and for nearly £400 I excepted to use it for a few years and not just 18months.

Here is a short extract from MSE's Consumer Rights guide:Know who's responsible
When returning items, beware shops trying the oldest trick in the book: saying they're not responsible for the shoddy goods and you must call the manufacturer. This is total nonsense!
If a company fobs you off by saying “go to the maker instead”, it's wrong. It's the retailer's job to sort it.
It doesn't matter if it's an iPod from a high street shop or a designer frock from a department store. If something's broken, torn, ripped or faulty, the seller has a legal duty to put it right as your contract is with it.0
