Error in Land Registry Title - Deed of Variation advice please

Hi,

We are buying a house (with a mortgage), still pre-exchange, and it has come to light that the Estate listed in a Transfer of part or registered title (TP1) has a mistake - the property is listed with the correct full address, but the Estate listed is a development in a completely different town. It's an obvious admin mistake and the company who were transferring the land, who it seems wrote up the initial document have admitted it as such.

The house was built in 2007 and transferred from the developers to the company in question (a housing association) and then the company issued the TP1 (the one with the error) to our sellers.

What exactly do we (or rather they) need to submit now to get this corrected and what sort of timescale are we looking at here once what has needed to be submitted has been? What repercussions might this have for us if we do not get it corrected (worst case scenario)?

We’ve already been going back and forth (banging our head against a brick wall) with our solicitor about this and he’d said they had agreed to do a Deed of Variation. A month later and it has still not been submitted and we are still unclear on exactly what needs to happen.

Any advice? There are 3 solicitors involved now - ours, the sellers’ and the company’s. It’s a nightmare. This is already our second house and we had the offer accepted back in February (there's no chain!)

Since you are paying a solicitor to do the conveyancing for you, I suggest you instruct them to.... do the conveyancing for you.

A key (major) part of that is ensuring that the seller has 'good title' to sell ie he owns the property in question, is permitted to sell it, and the Title of the property involved corectly and legally identifies it.

If errors exist, the seller should correct them. You should not bear any additional cost for your solicitor doing extra work to correct historic erors.

But be warned: this will delay your purchase.

If as you say the house itself has the correct address (and plan?), but the only error is some passing reference to what is obviously a different estate, I'm really not sure why that ought to be a dealbreaker.
