Part Cash / Part Voucher Returns

I recently made a purchase in Marks and Spencer and paid £125 in vouchers and £73 on my credit card. The purchase was for two suits and i returned one of them (£99) The return turned into a real issue for Marks and Spencer as they insisted that they would only refund me in vouchers and not the £73 credit cart element. It took me half an hour of arguing and only got it solved as the cashier felt sorry for me after the manager walked away. Does any know what your consumer rights are I this scenario. Refunding this way locks you into further purchases with The company and I don't see it as fair!!

    Right, so you paid £125 in vouchers & £73 on a card, you returned goods to the value of £99. I see no problem in refunding you the £99 on a gift card as it's the primary source of payment - they can refund in any order they wish to do so.

    Chances are after 30 minutes the cashier just wanted shot of you & refunded onto your card, personally I'd have given you the £99 on a gift card & ended the conversation.

    They are allowed to refund in the vouchers, its their choice.

    You have no consumer rights, all that's available to you is whatever returns policy m&s have in place. Another shop could have told you tough, no refunds at all ;)

    This doesn't fair at all, if they had tried that on me I would have argued too, I'd complain to their Head Office.


    If necessary you could have taken both back and re bought the suit with your gift voucher.

    The OP didn't go to another shop they went to M&S. If they bought just one suit and used the gift card then that would be perfectly acceptable to receive a refund onto their gift card but they didn't.
