Eviction Help

Hi all, I’ll try and make this as breif as possible…

My partner, our 3 children and I have been renting a 2 bedroom flat over the last 3 years.

the property is let through an estate agent so I asume with an AST

During our time here we have received numerous complaints regarding things that we are not guilty for. Our landlord has supported us fully and always taken our side with these disputes.

Last Friday we received a call from our landlord explaining that once again we had recieved a complaint of using chemicals and working from home at night ! This obviously is completely false (my partner and I both have day jobs) regardless to say the freeholder had requested that our landlord hand us 2 months notice (which he reluctantly has) or he would be in jeopardy of loosing the flat ?

We as tenants have never seen any evidence to support these claims (there is none!)

I guess my real question is where do we stand ? We are fully accepting of moving, and had been discussing a move next year regardless. however we cannot help but feel we have been bullied and harassed to leave over complaints that are purely fictional. Is there anything that can be legally done with regards to this ?

any help or support would be greatly appreciated.

    There's not much you can do. Your landlord doesn't need a reason to issue a Section 21 notice. It's not nice that your neighbours, or whoever, have hounded out of your home but there's no defence against a correctly issued Section 21.

    Sounds like an untruth to me. Ask for foundation to the claims.

    I agree - if the Landlord is onside, ask him for copies of all correspondence and then follow up with the freeholder under data protection - obviously they are holding data about you and it is false.

    There must be more to this than you have said.

    Freehlders do not invent complaints like this for no reason.

    Have you had disputes/disagreents with other residents in the building? Other leaseholders? What reason might they have for complaining? Or wanting you evicted?

    This is clearly an ongoing and lon-standing issue since (the freeholder?) "received numerous complaints regarding things that we are not guilty for".

    I'd be interested to hear the back-story.

    But be that as it may, unless your contract with the landlord is in a fixed term, the LL can serve a S21 Notice with 2 months notice at any time and without needing a reason.

    Do you have a fixed term tenancy?

    Is the S21 otherwise valid? Date of service? Date of expiry? Date deposit paid? Date deposit registered?
