Do I now do nothing but wait?

Hi All,

We had a windscreen PCN from the Forbury Retail park in Reading, managed by UKCPS Ltd and following previous advice I had read on these boards I waited for the NTK to arrive before doing anything, it arrived within the 56 day window so I used a letter template from here (that seems to have now been updated again) and posted it off to them.

I have now, not unsurprisingly, received a rejection of my appeal stating;
Unfortunately we are unable to consider your appeal. As stated on the PCN all appeals, from the Driver, must be received with the stipulated time of issue. After receiving the NTK the registered keeper may appeal if they have not already appealed as the driver. As your appeal was presented significantly late the appeals procedure has now closed and the parking charge will stand.
Now that all seems to contradict itself all over the place, I did challenge it as the Keeper on line one of my appeal letter.

So do I now do nothing as I have made my case and just see what happens or do I fire off another letter pushing for a POPLA code?

    You won't get a PoPLA code because they're not members of the BPA, and there's no point in pushing for an appeal to the IAS because it's a kangaroo court where you are sure to lose.

    They have actually helped you here by refusing you an appeal despite you complying with their arbitrary rules. In the highly unlikely event that this finishes up in court it will not look good for them!

    please re-read the newbies thread to see why , then ignore for 6 years unless you get court papers

    Thanks guys, I keep referencing the newbies thread (so much info) I'll see what drops through the door next then and make sure I keep copies of everything.

    This is the second recent thread I've seen where UKCPS are claiming a Keeper who appealed an NtK (after a windscreen notice) was too late when they were in time.

    New MO to deny the keeper any appeal route?

    Have you considered asking them for a v.a.t. invoice "in order that I may consider payment"? Asthis is UKCPS it will probably be a contractual charge on whichv.a.t. is payable. Have they accounted for vat on their paperwork? If not it becomes a breach of contract and GPEOL applies More reading here

    No, I would not ignore it. Search the forum for the Solicitor's name and read other threads.

  • I've been dealing with a ticket from UKCPS for a while, now. Don't ignore any letters they send you, simply send a polite (but firm) response each time. I personally would suggest that each time you include a request for ADR, and direct their attention to the Practice Direction, and their requirements under that (which include considering ADR). In all likelihood, all you'll get back from them are automated form letters saying that they are rejecting your appeal, and won't consider ADR as you appealed too late (I've had 4 identical ones so far!). This builds up a paper trail documenting their unreasonable behaviour, which you can use in the unlikely event it goes to court.

    At some point, you might get a letter from a certain solicitor's firm demanding £275 - if you get that, don't panic, just search the forum for the solicitor's name and you'll find plenty of responses to send back to that load of tripe :)
