Is this an LBC?

Hello, I'm new on here but hope someone can advise me?
I received a PCN in Nov last year from Smart Parking and have thus far ignored the threats from various debt collectors (DRP, Zenith) I have now received another letter from Gladstones Solicitors advising me that their clients "may now instruct us to take legal action against you in the County Court". Does anyone know if this is in fact an actual LBC or just another in a line of threats? I have never received an LBC and don't know what it would look like etc or indeed how it would be worded. I would add that I have not made any appeals which with hindsight and reading other threads I should have done.... is it too late at this stage? Also I am no longer in possession of the stated vehicle, any thoughts? Thank you

The clue is in the "may". In other words, they haven't been instructed to do anything. It's just another debt collector letter. Who does it say to contact?

Have a look at the LBCCC Fightback thread which tells you what a LBCCC has to state - and the 'Practice Direction' changed in April I think. That's a debt collector threatogram issued by a solicitor with their debt collector hat on.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Thanks for the advice it's much appreciated and rather as I thought. The letter says that I can pay online to debtrecoveryplus. I shall hang on in there for now then....

Exactly. Debt collector pretending to be solicitor.
