Compensation for 'black-listing' and charging?

Hi when I finished University in 2001, Natwest asked me to pay back my overdraft or threatened to 'black list me' or 'register my details' by the end of the month. I wrote back explaining I wasn't working with a suggested payment plan within the allocated time, but they still registered my name as a 'default' i.e worst possible category...i.e 'black-listed' before their given date had expired. I campaigned for over 2 years for them to remove my name, they kept promising it had been removed...the credit reference agencies: experian/equifax stated it hadn't. I eventually wrote to the CEO of Natwest/RBS and got a 'sort of' apology, saying it was my fault...but here have £250 knocked off what you owe us.

Anyway, I was wondering, would I be able to claim for compensation for all the trouble and upset I encountered over those 2 years. I have a folder full of evidence showing THEY WRONGLY REGISTERED MY DETAILS. I know I could claim some bank charges, but it won't be a lot because they all occurred in 2001 and before and then I closed all my accounts with them, so most of them will be unclaimable. I still get annoyed and upset thinking about this now, and would love to get something back from this horrendous experience.

  • you can do this, but it wont come under the reclaiming bank charges, and in your case, this will be difficult to prove. so I wouldnt even bother unless you have medical records supporting this

    Any overdraft is payable on demand......that's the nature of the beast.

    Surely I could claim for deformation of character, i.e. wrongly black-listing me, or for the two years when I was unable to get a mortgage and house prices tripled in price? I have proof they wrongly registered my details, there must be something I can do, since I did nothing wrong, after all, if people can re-claim bank charges...surely this is even worse?

    Hi, I used to work for a finance company. One of our customers died and his son took over the agreement (for a car). It was transferred into the sons name but they forgot to change the deceased part on the file. When the son came to get credit he was declined as he showed dead on his credit file. The man complained and the company I worked for and was paid compensation for the value of the credit he was applying for (about £1800 I think). I don't know if they had to do this by law or whether it was a goodwill gesture.

    I know it's not exactly the same but at the end of the day, in both cases incorrect info on a credit file has stopped someone getting credit. I would definitely look into it.

    Thanks I will maybe give that a go then, I think I might try the CAB first as there doesn't seem to be any info on this.
