UKPC Stevenage Leisure Park - Leaving site

So back in January UKPC decided to give me a ticket for leaving site, purely based on the location of my vehicle in relation to the adjacent train station. The signage there is awful and there was no proof given that I had indeed left the site. We had actually gone for a meal at the ASK restaurant on site, who were as helpful as they could be about the situation but basically said there was nothing they could do. I hadn't kept a receipt, so I waited it out and followed all the advice here in the sticky newbies section. I wrote to the landowner and got no response, UKPC turned down my original appeal, so as advised I went to POPLA.

UKPC's evidence quoted the "ParkingEye Ltd v Beavis" case so I was anxious if I was going to have any success or not as I had heard that quite a lot was riding on that particular case.

However, I got the POPLA decision today and my appeal was upheld on the grounds that the operator had not provided sufficient evidence that they had authority from the landowner to issue and enforce parking charge notices in respect of the site.

A brilliant result that took nearly 7 months and I would like to thank everyone on here who contributes and helped me win the appeal!

It just goes to show... DON'T PAY!!! APPEAL!!!! No matter what the situation!! Especially if you get a ticket at Stevenage Leisure Park!!

    Well done! :T

If you can spare the time, please will you add the whole PoPLA assessors words from your case to the PoPLA decisions thread at the top of the main page here so other people can gain from your success.

Well done on seeing this off. 'Leaving the site' is a potential graveyard for PPCs where a properly constructed appeal is submitted to POPLA (the IPC's IAS is a total lottery in comparison).

If you want to read a very interesting and amusing court case where the PPC were ripped a new rear and their lady solicitor threatened with a spell at Her Majesty's pleasure.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

one good thing about the "not a gpeol" being dropped to bottom place and possibly stayed for months is the assessors are being forced to assess appeals on the no contract and poor signage aspects, which seems to show that many ppc`s fail on these very points, possibly even some failing on POFA issues too , so we are now getting more successful appeals based on these other issues at last
  • That was a great read, would have loved to have seen their faces! :)
