Currys tv!

I got a 50" tv as a wedding gift 12 weeks ago. This weekend it became faulty so phoned currys, they said that's fine bring in it to my local store and they will send it to be fixed. Took it in today and because its an end of line product, they don't have the parts to fix it. (they don't actually know what the fault is!) . Told me they will give me a refund, but I don't want a refund as I wont be able to get another tv of the same size for the amount the person paid for it. It came with a years guarantee, but apparently that means nothing to currys, and all they will do is give me a refund! Legally where do I stand? The manager of the store refused to talk to me! Can I ask for another tv of the same size seeing as I've only had the tv 12 weeks? Thanks for any advice.

    This may be complicated because you didn't make the purchase.

    I would be inclined to accept the refund before Currys change their mind or work out that they may not owe you anything.

    You didn't purchase the item, so Legally, Currys don't have to do anything.

    If you did purchase the item, Currys are legally within their right to offer a refund, replacement, repair. A refund is legally correct, and you cannot force anything else.

    This is one of those "you can't please all the people" type scenarios. There are hundreds of people of these forums who wanted a refund rather than a repair and couldn't get one. Now they're offering you one, you don't want it.

    Unfortunately, it's all they have to do, so you can't force much else.

    Have you got in touch with the manufacturer directly to see if they would repair under warranty?

    Why dont you take the refund, stay in the store and buy another TV there and then with that refund money.
    But why would you want to buy another item from them in view of how they treat customers.

    Perhaps because...

    Probably sold off cheap, you cant expect a high cost replacement.


    Take the cash and put the difference to it for another.

    If it can't be repaired and is out of stock, what else do you expect them to do? If they offer you a similar model, you'll have to pay the difference in value anyway, since yours is secondhand-they won't give you new for old under warranty.
    Assuming this is a store-branded badge-job, parts are almost never available for them after sales, they're simply badged up and sold cheap to clear obsolete stock.
    No free lunch, and no free laptop ;)
