court thursday help

Hi there had a letter from nat west last week saying that the offer they offered me acouple of months ago still stands for to months . We go to court on thursday so i tould my husband to call them which he did and be fore he could say anything they told him that it was a mistake and he shouldent have been sent the letter. they had sent them out by mistake, that because we were at the court stage it dont count. allso i am very nervouse about the court case as it is my husbands account and its me thats done all the reserture and all the work ,i am just hoping he says all the right things. it is only a preminamal hearing (about 5 mins) i was woundering if anybody knows if i would be allowed in with him

had a letter from cobbits today saying they were asking for a stay to be put on the claim, well peeeeeeeeed off . called the court and they said that they had wrpte back and asked them to pay the appropiate fee,and as far as they are aware the case is still being heard tomorrow.but i was to call in the morning to make sure.is this a good sighn or not anyone no?0

i dont think it will happen, the court will put u on stay or natwest will pay out0

well im back,what a wast of time and money,judge had made up his mind before we even started (quote i have been directed because of the test case to staye the claim.)wouldent even let hubby say anything,the nat west bloke asked for a strick out but the judge saidit was a 5min hearing and if they wanted to put a strick out then they would have to go thru proper channels. he would not lisen to hubby when he handed him the letter about the appeal against the staye but hubby persisted and he took it spent months and months getting court bundle together and he dident whant that ether.we are absolutly gutted :mad: :mad: :mad: :mad: :mad:0

your right there before we whent in mr nat west asked us if we had had the document from cobbits about the particulars of claim. i told him yes but as we were not asked for it by the judge we didnt fill it in .am now woundering if i had filled it in would it have made a differance:mad: :mad:0

Sorry to hear your news Sue, the banks seem to be getting away with what ever they like at the moment, it shouldn't be allowed.
How on earth are they getting away with treating people like this? It's like the courts and the banks are in cahoots. What a conspiracy! :mad:0 -

Hi,
My husband and I went to Teesside County Court today against LTSB. A barrister for LTSB spoke to us before the hearing, he informed us that they had asked for a stay and that it would be in our best interests to agree to this. Anyway, we were called first and sat before a nice Judge who explained that he had been given directions to stay all cases pending the test case and the OFT. He said that the test case should last 8 days and will be in January 2008. He said that our case could be listed again after the outcome of this test case. He then went on to say that it would probably be October 2008 before any get heard.
He then asked if we had any objections to this, we voiced our opinions, however to cut a long story short LTSB got the stay. There were 5 other cases at our court today, so some very disappointed people i'm sure.
We are feeling disappointed but are hopeful that the High Court will come to the right decision in January.
Thanks again everyone for giving myself and my husband the encouragement and motivation to get this far.

Seems to be geographical luck of the draw. I was in court yesterday. Judge declined banks request for a stay in the interim. Told him I had been offered full money back verbally but not in writing. He said he would like the litigation man I spoke to to attend court in 28 days to be interviewed as to the verbal offer. He is based in London and I live 200 miles from there. Judge refused the banks request for costs nvolved in bringing him to court and said a telephone link was unacceptable. If I had to come to court then so did he. Surprisingly fair!0
