Popla appeal allowed - ngp

Hi All,

I just thought I would share with you my good news, that I have won my POPLA appeal against NGP Ltd. I submitted my appeal on 25th June and yesterday I received a letter from POPLA advising me that the Operator has cancelled my parking charge notice.

I spent a lot of time reading through relevant legislation and various pages on this website and was given additional help from other members, which I appreciate immensely. Thank you to all those who assisted me.

For those who find themselves in a similar situation of being stung by a parking charge notice, I can't stress enough how important it is that you fight it. My way of thinking is... if you're going to lose then at least make them earn their £100!

My advice to anyone appealing would be... use a template you find on this website and tailor it to your needs... read it more than once to make sure it makes sense to your circumstances. If you are able to take a walk around the car park you parked in check the following (amongst others)... is there more than once entrance to it? Are there signs at all entrances notifying you of the company's terms and conditions. Are they easily accessible? Are they lit up at night time? Do they face you as you drive into the car park or through it? Are they at a reasonable height? Is the car park pay and display? Is it a permit only car park? If the answer is no to any of those then you have an argument to pursue.

Also, make sure you take lots of pictures to prove the points in your argument and submit everything relating to the matter to POPLA. I made notes all over the letters I received from NGP to make sure whoever was reading my case at POPLA was clear that what NGP were saying to me was factually incorrect!

    Good result, great to kick this lot into touch. Obviously they couldn't handle the appeal points you raised and withdrew the charge. Whether this is classed as a POPLA defeat for them is arguable. What is inarguable is that you still beat them.

    If you're up for it, why not turn the heat back on them by complaining to the retailer/landowner who contracted them, that clearly they cannot justify their punitive charges, as they couldn't defeat your appeal at the independent adjudicator - POPLA.

    I'd be saying that you have incurred significant costs in defending this charge and you are looking to recover these. As principal to the contract, they are jointly and severally liable for the actions of their agents.

    Depending on their response, you will decide whether to issue a court claim against them as principal, as well a claim against their agent.

    Much 'bluff', but if the PPC wants to play dirty and dish out sh/t because you won't play on their terms, it's time to turn the tables. I'm sure the principal will be quickly on the phone to NGP asking some very awkward questions as to why they are now potentially exposed to litigation.

    Just a quick letter - let it hit the fan!
