DLA and housing benefit

Can anyone confirm that if a tenant is in receipt of the higher rate of DLA on both care and mobility,and is getting HB that any income that is going into the house from family is also disregarded. Im asking on behalf of a family member that is terminally ill , but im pretty sure ive asked this before as well , and that the answer was that no income is taken into account and full HB is given.
She cant understand this, and is worried that HB might have made a mistake .....and that she will end up owing money!
Can someone please put our minds at rest, and i can show her the replies

  • If a claimant receives high rate DLA Care then any non dependants income is disregarded for HB purposes.
    These are my own views and you should seek advice from your local Benefits Department or CAB.

    if the 'family member' is her husband/partner then income will be counted, but as HBO says, any income from a non dependant will be disregarded
  • They are non dependants... Son and his wife. , and her daughter.
    Why is it that if its a partner/ husband that income is taken into account, but not non dependants? A hudband/partner would only be bringing one income in, whereas there is 3 wages going into her household ..

    a husband/partner is expected th support their wife/partner as they are a couple.
    a non dependant is treated as a separate household and is not expected to financially support someone else household.

    i do agree that it is strange that an adult child can earn as much as they want to and as long as DLA/PIP care is in place, no deductions are made from housing benefit and council tax support.
    but them the rules ;)

    does she receive any other income related benefit ( ESA, IS etc) and if she does has she notified the DWP that she is no longer ;giving alone?
  • Yes she gets ESA also and all authorities know she isnt living alone.
    Just wish the non dependants would pay towards the household bills for her :mad::mad:

    that isnt a benefits issue though.
    she either has yp accept the status quo or tell them to pay or leave!

    i wasnt claiming benefit, but when my daughter and son in law moved in with me, i paid the rent and they paid all the utilities.

    i would suggest that a 3 way split with all the utilities is a fair amount to ask for considering they have no housing costs.

    did she lose the severe disability premium when they moved in?
    if she did, i would expect them to pay this as well
  • Yes i know she needs to tell them that... But being terminally ill, i guess she is just putting up with it for an easy life...
    Im not sure whether she gets the 'severe disability premium' is this not automatically paid?
    Her daughter has just given up work to 'care' for her, and is hoping to claim carers alliwance, and possibly IS i think? her dsughter has already got a car from her mobility allowance.
    Can anyone advise what the daughter will get for being her mums carer?
