CCJ on credit file while in IVA
Options
I'm two weeks from my final IVA payment!! My partner and I have decided to move house. After speaking with the estate agent about my IVA they have said it will be fine with them and the landlord to go ahead with the move. When the credit check was done it shows that I have a CCJ which was applied whilst I was in the IVA. This has put the move into jeopardy as it makes it look like I was lying! I have requested my report from Experian to find out which of the debtors applied the CCJ. Is this allowed while in an IVA? Does anyone have any advice around what I can do? The company who arranged the plan are Payplan, they're sending an email to say I have paid on time etc etc. also estate agent says on their report the CCJ amount says n/a?? Any advice greatly appreciated! Cheers Steve (almost debt free)

The IVA being in place should prevent a court from granting a CCJ, but only if the court is aware of the IVA. If they are not, it can get granted anyway.
Should be challenge-able/removable if covered by the IVA, either by the creditor themselves to avoid formal action or by you or your IP asking the court to set it aside.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB
