if your access is anything other than anytime you need to, I wouldn't buy your house. Equally I wouldn't buy your neighbours with your current access, but that's just me. Obviously lots of people live with similar access. It will make your property harder to sell if you amend it.
I don't understand why you are open to an amendment. Just say no, you are happy with the current situation. The buyer will presumably go and buy somewhere else which is less complicated.
I viewed a property with this sort of arrangement, and it had been informally modified to provide the neighbour with a path to the read gate. I wasn't happy so didn't offer. That's what the buyers here should do, instead of starting all this nonsense across multiple lenders/owners/solicitors.0 -
I agree, I would not want to buy a property where there was a restriction on accessing my garden. It's too restrictive to have to think 24 hours in advance and give notice, and could result in all sorts of issues with a an awkward neighbour.
Equally, i personally would not consider a property where my neighbour had a right of way over my garden. Your neighbours were foolish to make an offer / buy the property if they don't want this.
The obvious answer would be for them to move the gate to the end of the garden and either transfer a strip at the end of the garden to you so you have your own direct access to the ally, or move the gate and plan screening bushes etc so that you can can in and out but it is less intrusive.
