N1 from Civil Enforcement Ltd.

Hi

I know that there are a lot of threads about this bunch already but there are none with the specific info that I need.

I have today received an N1 form from CEL telling me they are taking court action to obtain £215 for 'contractual fees due alternatively as damages for breach of contract arising from the non-payment of the fees, or as damages for tresspass'. This is for a PCN issued well over three years ago. I never responded to their threats, as was the advice at the time. They also included a copy of a recent Court of Appeal Judgement for Parking Eye ltd. Vs. Beavis dated 24.02.2015. They have never proven I was the driver (there were multiple driver insured on the car).

My first question is can they really take court action for this more than three years later?
My second question is how do I appeal this in a way which will vindicate me from having to pay a single penny to these cowboys?

All help appreciated, these guys are bullies.

    1. They have 6 years to take action

2, Read the newbies sticky thread to find out advice once you have received court papers.

What was the date in 2012 you got the original PCN?

Why "apparently"? (The date could be highly significant to your defence!!)

'Apparently' as in 'according to them'.

ok please google "co-op cel" and you will see the fiasco mentioned multiple times on hear , pepipoo parking prankster and many more sites , follow the links and you will see the outcomes , and in many cases how much it has cost CEL , the %%^&%^% even took co-op staff to court after they were booted out of the co-op , and there is a test case , (in Bristol) that is on hold till after the bevis case

As you are in NI you just keep on ignoring until you get genuine court papers.

Threats of court are just another continuing scaremongering tactic to catch out the unwary/uninformed.

Update us when the real thing arrives.

    Meanwhile sleep easy.

How are you working that out? Are you confusing N1 with NI? Or is N1 specific to NI?

OP - is it a properly-stamped claim form with a claim reference number? Or is it a copy form used as a threatogram? If it's a proper one then it'll likely need to be responded to.

N1 form can be downloaded here ---> http://hmctsformfinder.justice.gov.uk/HMCTS/GetForm.do?court_forms_id=338
