Grimble: I did read the stickies-hence I wasn't originally inclined to appeal to POPLA as I know they will not take mitigating circumstances into account, but I wanted to show willing, like I am doing all I can to follow the correct protocol if it ever went to Court (which I doubt it will)l. I am happy to get their rejection letter and then just file all the debt collection stuff which I expect will come my way. But hoping that Hurn's themselves can intervene and get the ticket withdrawn.0 -

I don't know who the landowner is. It is parking in front of a row of shops and in particular the chemist. The signage just says it is parking for local businesses. Perhaps I should just write to the chemist? But doubt they actually own the land...
If you've only missed POPLA by days, appeal NOW online to POPLA. I have put POPLA appeals through a week late and they've been accepted. A month late is too late but a couple of days is NOT.
Just submit some bullet points TODAY which gets the appeal acknowledged, then write up a full appeal over the weekend and submit it as evidence after. And for the love of God, don't submit weak bullet points - your POPLA appeal does NOT have to match your first version at all. Start again and submit some decent points this time about 'no loss, no landowner authority' etc. as per the hundreds of recent examples you can find with a quick search for 'POPLA appeal' or similar on here.
Add in the Blue words I suggest in post #3 of the NEWBIES thread, about your case being stayed for Beavis if not decided earlier.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thanks-yes, I initially didn't see the point in trying to go via POPLA, as advice previously seemed to be that it would be rejected anyway, but as I have said in another post, I felt actually it was a good idea to go ahead (even though I'm a little late), just to follow the correct protocol and see what happens. Thanks for pointing me in the right direction. There is so much to read and take in on the stickies-it will take a while to work out what it all means.0

Errrm...we've never lost a POPLA appeal, what have you read?!
You do not need to read the stickies in detail, no need to pore over anything at all today. Just bung in the usual bullet points you will find if you search this forum for 'POPLA Appeal' or maybe 'POPLA NPE'. You only need to grab the usual POPLA bullet points repeated time and again in threads and bung them in - could be done by lunchtime (bullet points only plus my words from post #3 of the Newbies thread).
Then add a stronger set of wording at the weekend as evidence, as a PDF.
You could even just put in 'there was no loss and no GPEOL, the signs were not seen and they have no authority from the landowner' plus my blue words from post #3 of the Newbies thread) right now and that would be enough for today - you just need your foot in the POPLA door.PRIVATE 'PCN'? Thanks coupon-mad. Perhaps I misinterpreted some of the previous advice on this thread. Initially being advised I was too late to apply through POPLA and then that there wasn't any point as they don't listen to mitigating circumstances. But the latter point may have been relating to how I appeal, rather than the appeal itself. I am happy to follow your guidelines and use the correct language in my appeal to POPLA, rather than just telling them the facts-as from what I believe I understand from this, is they won't be interested in the circumstances anyway. So I have to use specific terminology and reference to the previous case etc. What a pain to have to go through all this. How much nicer if they had just been human about it and understood the scenario. Oh well!0

It was thought POPLA were very strict on the 28 days but in fact, they are not bothered where it's only a few days late (in my experience). If you get it chucked out for being too late you could complain to the BPA (Gemma Ridgewell, POPLA Liaison Officer) telling her the couple of days as because you were on holiday and could she please talk to POPLA to extend the use of the code. But no need for that I shouldn't think!Personally I would attempt to appeal to POPLA. On 9th July the European Union Alternative Dispute Resolution (ADR) Directive will come into force giving consumers up to 12 months access to ADR e.g. POPLA. It's only the PPCs who restrict the time limit within which appeals can be made. If this case were ever to come to court then you would be seen as reasonable in trying to use ADR rather than court & conversely NPE would demonstrate that the are being unreasonable by refusing access to ADR.PRIVATE 'PCN'?
