Damage to Alloy Wheel in Council Car park - Can I claim for the damage?

    Absolutely no chance, and rightly so.

    Why should every other poor sod's Council Tax bill go up because you can't judge the width of your car properly, or were so desperate to park in that particular car park you risked parking in a space you knew was too small for your car?

    I'm not disagreeing with your view that they have no chance with a claim, but just so it's clear, nobody's council tax bill will go up because of a successful claim.

    How exactly would the council fund paying out compensation to somebody then? Where would the money come from if not from the council's coffers?

    Genuine question.

    Thanks to useful replies, shame about the fully expected idiotic soapbox troll comments but probably have to agree with the general consensus that it's my issue.

    Sorry if you feel that any posts (mine included) were 'idiotic soapbox troll comments' because they didn't agree with your expectations for a few quid in compo.

    My post wasn't intended to be 'trolling'. I just don't see why someone else should have to pay to fix damage caused by your own ineptitude.

    Genuine question.

    They have budgets and reserves specifically for claims and other liabilities. As with any business they have insurers who deal with claims. This is the case with my local authority which passes highways damage claims to Zurich (if they don't reject the claim themselves).

    Birmingham City Council has a deal with Amey and it's that private firm that is liable for all public liability claims, not the local authority.

    Making a claim does not mean anyone's council tax bill will go up.

    I agree with the consensus, you hit a static object ergo the fault was with you.

    Unfortunately, the idiotic soapbox troll comments come as standard on this section of the MSE forums. Luckily, they are rather less common on the other forums.
    If it sticks, force it.
    If it breaks, well it wasn't working right anyway.
  • If you can show the council was negligent then yes, you have a claim. It might be a high burden and I'm not sure how you would go about it but nonetheless, that the law of tort and not just a naysayer's opinion.
