6 Month Break Clause Notice Period

Hi all,

I have been trying to search different forums etc to find out the answer to my question, however, I am finding everything is worded differently and I'm a little confused.

Basically I'm trying to find out when would be the earliest date I can end my tenancy. Am I able to give notice at month 4 and hand the keys back at month 6 or do I have to wait until month 6 to give the notice and hand the keys back at month 8?

My tenancy started on 14th March 2015 with a 12 month contract including a break clause at 6 months (2 months notice required).

This is the exact wording of the clause:

"The tenant may determine the Tenancy at any time after the expiration of the first six (6) months by giving the Landlord or the Landlord's Agent not less than two (2) months' prior written notice of its desire and up to the time of determination (which for the avoidance of doubt will not be earlier than six months from the commencement date of this agreement) pays the rent and reasonably performs the obligations on his part contained in this agreement then on the expiration of the notice the Tenancy shall cease and determine but without prejudice to the rights and remedies of either party against the other in respect of any antecedent claim or breach of obligation."

Any help from members of the forum and any experts would be greatly appreciated!

    Yes.

    Bit in bold refers to the time of determination, not the date you give notice.
