Letter from viewer

Hi all, I wanted to ask some advice about something, please.

I recently changed estate agent and received an offer after an open house. Two weeks later this offer was withdrawn. The reason given "not close enough to work".

Anyway, last night there was a letter posted through my door from another couple, saying they want a second viewing but can't get one. It turns out they viewed via EA 1. They then tried to book a viewing through EA 2 but let slip they had viewed before.

To cut a long story short, EA2 referred them back to EA1 but they have fobbed off the couple.

I'm now not sure what to do. I have a feeling it's going to cost me more in EA fees but also EA2 has already told me he would not contemplate doing a joint with the other EA.

I've put off phoning the couple and can't contact EA until Monday, and even then I don't know what to say :(

Sorry to rant, any advice greatly appreciated.
I must remember that "Money Saving" is not buying heavily discounted items that I do not need. :hello:

    First, read the contract you had with EA1. It probably states they are entitled to a fee if they introduced the buyer. It this is the case, find out why they are turning the potential buyer away. It seems odd they'd turn down fees. If they are being silly about this, ask them for a written waiver of any entitlement to fees. I'd speak to the director of the branch.

    EA2 has done the right thing here.

    It would depend of the contract with EA2 as well. Plus the EAs may have codes of conduct that covers this.

    I thought the normal procedure when you change agents is that you ask EA1 for a list of people who they have introduced and you agree with EA2 that should one of the people on the list pop up again and buy the fee goes to EA1 and not EA2. Presumably that would need doing before signing with EA2 as you have more clout then.

    They only want a viewing at this stage so no harm in that, it's only if they offer you have a headache. They may not offer after viewing again.

    As others have said, check your contracts...

    ... but assuming you have 'typical' sole agency contract, the prospective buyer should continue to deal with EA1, and EA1 will get a fee if they buy.

    If EA1 seems disinterested, you could deal direct with the prospective buyer. But if they buy, EA1 will still be due their fee.

    I love this reason. Implies the OP's house moved from when they made the offer to the date they withdrew it.......

    If I was in this situation, I'd invite them around and let them view the property again and chat to them. If you scare them off, great - no hassle with regards to who gets what fee. If they love it, great - you can sell your house!

    They seem keen if they've had to write directly to you, and the trouble isn't their fault. If they've left a mobile number, why not just send them a text to let them know that you are trying to sort it for them? At least then they're not sat at home wondering if they've made a big mistake contacting you directly.

    Been doing a hectic tidy, lol.

    Brilliant. They clearly want to look at the house and are strongly considering it. I hope the viewing goes well.
    I'm glad they're getting another viewing. I felt for them a bit when reading the original post.
