car insurance claim problem

I had an accident in my car at the end of December 2014 where someone attempted to do a u turn in the road from a parked stationary position as I was driving past causing a collision and damage to both cars. I informed my insurance company of the accident that night and the next day I sent them my statement and diagrams as requested but there was no independent witnesses. my car was repaired and every time I called my insurance company they told me they had not received any correspondence for the other drivers insurance company since the accident but they had sent them my statement etc. A few months later when I called them again they said the other car insurance company was disputing the claim and I was told not to worry as they could pick holes in the other drivers statement if they needed to.
I called them again last week and they third parties insurance company has offered 50/50 blame and that my insurance company would be looking to accept this and they wanted my thoughts on it. They sent me a copy of third parties statement and diagram by email and when I read it I was shocked to read this opening line from it
"I wish to advise you that I strongly disagree with the statement from other driver. His version of events is not correct"
His statement and diagram are completely different from mine which I expected but it appears obvious that he has seen my statement before writing his own and when I queried this with my insurance company they just said they do not think his insurance company would of shown my statement to third party at this stage! They also went on to say they would be accepting 50/50 as both diagrams are the same and the damage is consistent with them. I have told my insurance company the diagrams are completely different and that the damage to both cars is consistent with my statement and diagram and not his and I told them by the third party seeing my statement before submitting theirs puts me at a significant disadvantage.
I have contacted financial ombudsman service who have opened a case and have contacted them but they will not get involved at this stage until I have gone through complaints procedure with my insurance company first.
The question I have is have I been treated unfairly regarding third party seeing my statement before submitting there own and do you think my insurance company has not handled my claim correctly from the start.

If you were 100% sure you were in the right you should not have gone through your own insurance but gone through his insurance.
As it stands your insurance company have paid for and repaired your car and they obviously think it is not worth pursuing the other party for their losses.They will probably be happy to reduce their losses by accepting 50/50.
I don't think your insurance have done anything particularly wrong, they have repaired your car, on the other hand you made the mistake of letting your own insurance pay for the repair.
As it stands it will be classed as an " at fault " accident and you will lose two years ncd until you win against the other party.
Employing an accident management company might have been the best option but your car would not have been repaired until the other insurance company caved in.0
