Compensation for gastroenteritis at holiday resort

Who are you wanting to compensate you? The agent isn't responsible for stomach flu that could have been picked up from anywhere/anyone. The bedbank (who I presume it how the agent booked the room) isn't responsible either. Unless you have proof it was caused by food poisoning ie the doctor on site took samples and they tested positive, then how do you hold the hotel responsible.
Your insurance might have cover, but that depends on your policy.0 -
The only way you would get compensation is if there were multiple cases at the same hotel at the same time as this would indicate a common source.
Unless you have special insurance that goes beyond thestadard that is?0 -
We successfully got compensated for a holiday company sending us to a resort they knew was sub par at preparing food. We were part of a class action that helped to prove that it wasn't an isolated case and had a news paper report showing that the issue had previously been highlighted to the holiday company. We had photos of birds and mice in the food area (it was a sort of marquee restaurant) and other guests had managed to get photos of the dirty kitchens.
In all it took 3 years. My dad (the one who fell ill got the full cost of the holiday back, mum got 50% and my sister and I 25%.
Other guests got less or nothing at all as they didn't have medical reports or hadn't reported it at the time and asked the travel company to fix it.0 -
Do you even know if other people have been taken poorly? Surely before trying to get money for your convenience, that would be the first port of call. It could then be a very long process to get evidence that the hotel acted innapropriately resulting in conditions that would be likely to cause the illness. Good luck.0

Did you send off samples for a diagnosis either in Egypt or on return to the UK? They can be traced to quite specific strains-and would help identify the cause. Without those it is much harder.

I hate to be the bringer of bad news but unless you bought a package holiday you may have no claim at all, except possibly against the hotel in Egypt. The Package Travel Regulations can oblige tour operators to take responsibility for illness caused by a hotel but so many people now book flights and accommodation separately thinking they are saving money without realising the consequences.
Begin by having a look at the ATOL Certificate you got from the travel agent, in the bottom right hand corner it should say either 'package' or flight plus sale' If the latter then there is no tour operator at all but separate contracts for the flights and with a company that processes hotel books such as Hotels4U or bedsonline etc. In 99% of cases their own booking conditions say there is no contract with them at all as they only act as an agent for the hotel.
This means you might have a claim against the hotel, subject to Egyptian law which you really do not want to have to use, but as others have commented, food poisoning never strikes just one person, particularly at all inclusive hotels. If you are not aware of others who suffered at the same time, even if you did buy a package holiday, then you are likely to have an uphill struggle for compensation.0 -
The reviews of the hotel are really good. One person mentioned food poisoning, claiming they were both doctors. Were they doctors they would have known you can't claim food poisoning without having samples tested. The managerial reply did point out they never had a case of bacterial food poisoning at that hotel, and that they were audited shorty afterwards and nothing was found.0

That doesn't surprise me really. The easiest place to pick it up is the pool. Someone has a bit of a dicky tummy, goes swimming, bacteria enters the water, the rest, well you can imagine.....Accept your past without regret, handle your present with confidence and face your future without fear0
