Lay off

Hey, I'm just wanting a bit of advice or wondering if anybody can point me in the right direction where I can get some please......
Back in 2013 I left work on normal mat leave and they took on a temp to cover my job, when I went back in 2014 the girl was kept on, I went part time and she took a full time position, we split the work accordingly, I then got pregnant again and went back after normal mat leave at the beginning of April this year and the work split went back to what it had been. Work went quiet and today I have been laid off but she has kept her job, would I be entitled to ask my boss why I was laid off and not her and also are there any rules etc on returning to work after maternity leave and being laid off etc or am I just clutching at straws, Tia

    Do you mean redundant?

    (lay off is different, although often a term used when it is actually redundancy)

    Of course you can ask why you and not her but forget the maternity leave it's not relevant - any special protections you get while being on maternity leave end the minute you return to work after maternity

    I'm not a legal expert, but that sounds both logical and sensible- if they currently have enough work for a full time employee, but not for both a full time and part time one, then it makes sense to lay the part time employee off temporarily, regardless of who's been there the longest.

    Could/would you do the role full time ? If so, and it got to the point where redundancy was on the table, you might be able to say to them that they should consider both of you for the single full time role ...

    Check your contract carefully, layoff or change in hours is not an automatic right for employers
