VCS Notice of Intended Court proceedings

I have received a letter from Vehicle Control Services titled 'Notice of Intended Court Proceedings' It says my appeal was unsuccessful and if I do not settle the outstanding debt of £100 they MAY commence debt recovery action or legal proceedings against me without further notice.

After lots of reading of related posts and the stickies I am still unsure what to do. I am tempted to ignore it as just a bluff letter as it doesn't say they are definitely proceeding with legal action but that they may, but then I'm thinking is it actually a LBCCC, in which case i should respond.

Any help greatly appreciated

I'm terrified just reading about it.....NOT.

    Clues:

    'they MAY commence'

'ignore it as just a bluff letter as it doesn't say they are definitely proceeding with legal action'

op - you've done well to read sensibly and mostly absorb a lot of newbie advice, so don't stop now.

Reinforcement: NEVER EVER RING OR COMMUNICATE WITH ''DEBT'' COLLECTORS

Anything that purports/appears to be a legal MCOL document or LBCCC will be clearly that and you can ring the issuing Court for confirmation.
Be careful as some scumpanies have been reported for mimicking Court stamps on docs.

  • Thanks ampersand, as I suspected but I just needed some reassurance! :)

Alleged contravention of 'stopping on a roadway where stopping is prohibited' at Humberside airport was on 4th December 2014

An airport 'stopping' case is the very last they would ever present in a court. Their grounds to pursue this are so shaky. Losing one of these at court would not only bring down the Humberside house of cards, but also the mansion of cards that is their activity at Liverpool John Lennon Airport.

If you're a 'stick-it-up-em' sort and you're up for it, tell them that you would welcome them laying court papers as you want to get their activities at airports in front of a judge as soon as possible. You will presume that if papers are not served within 28 days, you will consider the matter closed and assume they do not wish to risk exposing their actions to a judge.

Then see how brave they are!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Did you appeal to the IAS and get turned down? If so you are virtually home and dry.

The IAS adjudicators heavily favour their paymasters, do not sign their decisions, and frequently err in law. Most decisions are perverse, and flout due process.

Any PPC risking a judge seeing one of these "independent" decisions would be very unwise indeed. AFAIAA, no case has been taken to court following an IAS refusal.
You never know how far you can go until you go too far.
  • I did appeal to the IAS but they refused to accept it as I was outside the 21 day time limit, therefore they were unable to assist me further.

As much as I would like to stick it up 'em, I resent spending anymore of my time researching/writing letters to these parasites, so I'll probably just ignore any further letters. However if the little devil on my shoulder gets the better of me and I change my mind I'll update the outcome here...

    Cheers guys

You may have to wait a long time for an answer, as they haven't been active since their last post.

I very much doubt that VCS have taken anyone to court for stopping at Humberside, as it would have been well publicised on this forum.

If you require any help or assistance, you will need to start a new thread.
