Can my friend set up a business name without telling the parent company ?

Hi,

My friend is trying to set up a company J P Morgan Mortgages Help via the companies website. I think that he needs to get permission from the bank before he can do this so would be grateful if someone could confirm. My other queries are :

1. Can the bank sue him for not seeking their permission beforehand ?

2. How does he get their permission to proceed ?

    Oh dear, why should I speak to you or any solicitor and waste money ?

    With that attitude its unlikely that any bidy will be willing to help.
    Eat vegetables and fear no creditors, rather than eat duck and hide.

    Can they? - Yes. Will they? - They certainly will!

    He won't - ever! Why would they - he's trading on their good name & reputation !!!!!!! They'll sue his !!!! off, and they've got plenty of money to do it with. Google "Passing off".

    What a stupid idea!

    They either fly under the radar a while and get away with it, or JP Morgan find out, and get stroppy. Considering the amount of money at stake, and considering the name is registered in bad faith, with the intention of confusing the consumer, their wrath will likely be severe and sizeable.

    Companies house won't stop them from making the registration, but it would be a pretty bad move to try.

    Look at other industries for examples - Mc Donald's (fast food giants) managed to force a name change of McDonald's caf! in Scotland somewhere, owned by the McDonald family for decades - and they even had a good faith right to the name!

    Your friend can do this, however, the consequences will be rather costly.

    And even if it's not with your attitude about my assistance I couldn't give a monkeys you ungrateful fool.

    Honestly, if you want a watertight answer with someone that takes responsibility then pay for it. If you expect it for free then you are plum out of luck.
