    The one benefit they have is lower monthly payments, a lot of people will choose this garage over another if the payments are less, and obviously they don't have to discount the car to do this so commission is higher.

    Its so that the monthly payments are lower and the customer is more likely to buy.

    Hmmm.... The accusation isn't that they hid the 5k pa contract, though, it's that they pushed it through without the customer's informed consent.

    The customer knew of the issue before signature, and is unlikely to have been fooled in the traditional sense that they were getting a lower price simply because of the generosity of AC.

    All of which begs the question: why is the OP only seeking to resolve this now? Why didn't they act immediately?

    OP what do you plan to do with the car at the end of the contract and what did you tell the salesman your plans were
  • I think whatever you choose to do, a complaint should be made to the FCC. This is precisely the kind of issue they've been trying to rectify with miles and miles of increased red tape.

    He has lied to you. Anything a salesman says to you is just as binding as anything that is written. He can't tell you one thing and make you sign to say another.

    If you pay the final balance no problem, if you part exchange then the car will be valued with the higher mileage. It is only if you choose to hand the car back that you will be hit with excess mileage.


    Still very naughty of the SE. You could if you want call the finance company and get them to adjust the mileage??? But it may just be better to face the fact then when you come to part exchange you may not get as much as you 1st thought.

    If the valuation of the car is lower than the original GMFV, then the OP will still be charged the excess mileage.

    It is unlikely that (unless a larger than typical deposit is paid), with the amounts payable under a PCP, the buyer will achieve the amounts to qualify for the half rule.
