New mobile with intermittent fault

I got a phone with carphone warehouse 3wks ago and randomly when I make a call the other person cannot hear me unless I reboot the phone.

I took into store and the bloke said "if I cannot see the fault I can't book it in".

My experience so far of cpw customer service is pretty crap and now this it makes me gutted I left virgin.

Is there anything else I can do as I cannot make the fault occur, it just happens randomly.

    If its within 6 months its the RETAILER who has to prove its NOT faulty, not you who has to prove the fault. I suggest packing up the phone, taking it all back with a letter before action. If they don;t swap the phone over or refund you then leave them the letter and give them 7 days before you go to small claims court. Normally they will back down, be polite but be firm, tell them you are rejecting the item under sale of goods act.

    Well if they cant find a fault isn't that proving it's not faulty? I think your getting mixed up with the fault being inherent at time of purchase within the first six months, there is a difference.


    Op can you record your conversations so when it happens you have proof of the fault.

    But its not down to the OP to prove the fault. He could get a recording of the problem but I'm 100% if he stands his ground then CW will just replace the phone.

    I agree it's up to CPW to prove it is not faulty, however if they make a call and the other person can hear them, that would be proof it works.

    It's a pain in the backside having an intermittent fault - the advice above about recording it is the best course of action.

    Has the OP tried doing a factory default? Which make of phone and have you updated the software on it?

    I've had this following Android updates a couple of times, it's always been fixed by switching it off and on again.

    the OP has stated that the phone works after he has switched it off and on again (reboot) , so I don't think that's the problem

    Hi, I am having a similar problem with CW. My samsung galaxy S4 which I got in December keeps switching itself off. I never know when it's going to come back on. The first time I told them and they just noted it but didn't do anything. Second time they sent it to be repaired. Within 3 weeks it has happened again. This time I wanted to change the phone, but they insisted it has to be repaired again. If the fault is still there after that they will replace it, but I don't want the same model. Looking on the internet it turns out to be a common fault so Samsung must Know about it, but CW are 'pretending to fix it' instead of giving me my money back or letting me change to a different phone. The current one is not fit for purpose.

    Going to depend upon date of purchase more than 6 months and its up to you via an engineers report to prove that .Less than six months then you need to push the vendor hard
    Samsung themselves offer a extra limited two year warranty .

    What network is it on?

    My Vodafone sim has been really crappy for the past couple of months, constantly requiring a reboot of the phone (been away on business so not called them yet)
