Planning permission application above flat we are purchasing

We are currently in the process of purchasing a new flat on the top floor of a conversion (used to be offices). There are 2 floors of 7 flats each - all brand new. So far, the vendor's solicitors have seemed very slow at answering queries and it has been 3/4 months since we had the offer accepted. All 14 flats remain unoccupied.

When our solicitor did searches, we noticed that the developers/agents have put in a planning permission application to build 4 flats on the roof of the building, directly above our flat. This was never mentioned by the agent but luckily was denied by the council and we let it go. For interest: Richmond Upon Thames Ref: 15/1167/FUL (sorry, can't post links).

Now, they seem to have put in another application to build 4 flats on the roof. It's too early in the process to view the application but seems identical from the description.

We are annoyed that they haven't mention it at any time during the process and now suspect they are deliberately dragging their feet with selling the existing flats. Maybe they don't want to let us lodge a complaint as tenants?

Either way, if this gets approved our flat will no longer be on the top floor (even though it was advertised heavily as a top floor flat) potentially devaluing it. The construction work will be horrendous and probably right about the time we were planning on selling it.

I know this is our decision whether or not to continue with this purchase but I would be interested to know what fellow MSE-ers would do in this situation?

    Even if this application is again denied, it seems likely the developers will keep trying, so eventually

    a) you'll end up not being the top floor and
    b) you'll have the disruption of the building works

    Either accept that, or walk away.
