I am currently embroiled in a case with the ombudsman regarding the wonderful company Wonga.
After taking a smal loan from them in 2009 I paid it off and cleared it after a few roll overs, no hassle no problem. last year I recieved the letter about them and their dodgy dealings with fake solicitor letters, I never recieved one of these as my loan was paid off. However I filled it in and sent it off. Then I looked at my credit report and there was an 'outstanding' default from Wonga on there that only appeared last year despite having no dealings with them since early 2010 and my loan all cleared and took them 4 months to get rid of it.
So I complained and got the usual ignorance and shun responsibility for about 6 months of palming me off from them so contacted the ombudsman who have taken up my case and seem to be in my favour (which is a no brainer) however they cant do anything until Wonga provide them with the documentation and reason why they added a default but true to form their standard answer is 'they are looking into it and its taking longer than expected'"!
Is there some sort of time limit they have to respond to the ombudsman, this has gone on for a year now...?

Yes, the ombudsman service will expect a response within a certain timeframe, if not sooner.
Ask the adjudicator for more details if interested.0 -
Thanks for the reply, any idea what the time limit will be roughly...?0
-
Response to emails etc - 2 weeks.
Response to provisional assessment (adjudication) - 6 weeks.
These can be extended ON REQUEST (probably indefinitely). In summary, Wonga have 2 weeks to provide any request for details (case file).
You can keep banging on to the adjudicator for updates. You could, ask the adjudicator to pull off a report listing all the open cases Wonga have at the FOS. You can the ask her to see if they are ignoring the FOS in other cases. Or, put in a complaint http://www.fos.org.uk/publications/factsheets/complaints-about-our-service.pdf but all of these will result in you annoying the professional and diligent adjudicator, losing your case anyway so your stuck.
Much of this is covered here.0 -
Thanks quaybab. Yeah thats why I came on here for advice because I didnt want to keep perstering the adjudicator because he has been very helpful so far and dont want to annoy him.
Cheers anyway.0 -
Wonga will have to give a reason for the extension, which can be refused if necessary, but in general it should be no more than 2 weeks each time to be dealt with.
It can take a while to sort out, but from what you've posted, you should have a good chance here anyway, especially as you've not had any dealings with Wonga in this time.💙💛 💔0 -

Take it you've queried this with the CRA to?
Could have been cleared up by now
Here's a dittie for you - found myself freshly unemployed so really down on my luck completely again, one of the PDL debt's I would have overpaid moons ago but never wanted to complain about, now more recently offered the chance of a job interview with them... so it really does pay to let some things go and not always chase compo.0 -
Thanks for the input Keepcalm, however I'm pretty certain I will not be applying for a job with Wonga.
All I wanted was it removed as it had no right being there, yet they didnt play ball so my hand was forced.0 -
Look at it positively....
The more time wasted, the more likely FOS are going to ask them to pay further compensation for it.
The FOS provide the companies with deadlines etc but if they are backlogged etc, they do have to give them a chance to get round to it...however the longer they leave it, the more FOS are inclined to favour the customer - or ask for compensation for the delay in itself and the terrible customer service.
I hope this goes well for you, but try not to bug the FOS too much, as it certainly won't be them lagging behind.0 -
Thanks smdabs, no I wont hassle them I appreciate their job and they have been in touch regularly.0
