Major Predicament

Iam due to move to a new house on friday 26th june and recieved a phone call from my solicitor to say there had been a mistake in the paperwork which has been exchanged with the solicitor i am purchasing from as the date had been agreed as 30th june this date has never been mentioned to me at any stage in the last two months that dealings have been going on for . I immediately phoned the seller whom i had spoken to on sunday confirming i would be picking up the keys from their solicitor on friday and she said that friday was the move date and would contact her solicitor to get an explanation.She has phoned me back to say that because my solicitor has two different people dealing with the buying and selling this is how the mistake was made and says it is doubtful things can be sorted at this stage!!! My solicitor suggest i stay in a hotel to tuesday surely they cannot be serious i have made many arrangements for the move to happen on friday including removals deliveries at new adress etc etc .There house will be empty from friday and i have to move out on friday but may not be able to pick up the keys till tuesday. Any advice appreciated

    Provided both you and the seller agree, there is no reason your respective solicitors cannot alter the Completion date.

    Instruct them to do so. They work for you.

    GM though the seller agrees and will be out of the property anyway she and her solicitors have not had a good relationship with my solicitors over the last two months as there has been a lack of communication been between everyone in volved and it seems they are quite happy to see me suffer as a result of the error made by my solicitor

    my solicitor told me the seller will not budge on the date

    Nor can you! If your solicitor made the mistake, it is up to him or her to sort this mess out or foot the bill!

    Have you checked the actual contract? I thought this date was in the details you get to read before exchange.

    So it sounds like you are somewhere in the middle of a chain.

    And the chain below you is completing on 26th June and the chain above you is completing on 30th June.

    ... but how can your seller move on 26th June? They won't have your completion funds until 30th June. Or are they moving into rented?

    ... but if they're moving into rented on the 26th, why can't they complete on the 26th anyway?


    I think you need to push your solicitor for an urgent explanation of what's happened and what they are doing to fix it.

    It sounded to me more like both the OP's current house, and the house they are buying were due to be exchanged on the 26th, but that one or both of their solicitors made a mistake and put the 30th on the paperwork, and are now refusing to change it.
