Severe disability premium

Hi, I was wondering if anyone can advise. As I am
Not sure if this right . My sister receives DLA . Middle rate care. High mobility. She is in the support group for ESA. No one claims carers allowance for her. But she has been told she can't get SDP because she lives with me?! It's just us 2 in the bungalow.
Is that right? Even though I am not responsible for her. Yet people who have partners can get it? I'm at a loss. Thank you

The other criteria that you missed out, is that they have to live alone or be treated as living alone

And if you do not fall into a category, then your sister will not get the premium.

Thanks so she is penalised because I live in same address as her. Even though I am not responsible in any way for her. Yet if someone has a partner who lives with them. They can claim it!?. Baffling.

    Your wrong.

I receive middle rate care and high rate mobility of dla.

I live with a working partner, and I don't qualify for the disability premium.

    If anything, I am penalised.
  • should both people living together receive mid rate dal care then they both qualify for sdp

I can see why you would not get it, if live with a working partner. Thats what a parnership is. You share/provide for each other when in a relationship. I can understand they would not give it out on that merit.
My Sister doesnt have a partner. I feel gulity now, because I am depriving her from money. Just because I live at the same address as her

so you live with her for free or do you share household costs ( as you should do) ?
do you help her with things she has trouble doing?
    are you supportive towards her?

the SDP is paid for the additional costs that a lone disabled person incurs.
possibly higher utility bills ( that you should be sharing)
having to pay someone for support ( that surely you are providing? )
if you worked it out in monetary teerms, you may well find out that she is better off losing the SDP and having you there, than she would be living alone and receiving an extra £61 a week

It is my Sister who posted that. Does that cause a problem to you, charlieismydarling ? us sharing the same username. I dont see what difference it makes or why you have even brought it up. I guess you must have been bored, clicking on 'username' and 'find all posts'

nannytone I do not live with her fulltime. I am based in the city. So come back 'home' friday evening, and return sunday eveing and holidays etc. Of course I pay for what I use when I am here. I am no free loader
Ive discussed it with my parents and decided to use their address from now on as my base when I am home. That way my sister isnt getting done out of £244 a month. It would make a difference to the quality of her life having that extra money.
  • I have looked everywhere to try and find the right information.i have been getting pip since last year and i was also geting esa, during that time i was sent an IS10 form (severe disability premium form)which i filled in and sent back,i was awarded it but then in january i went for a back to work medical which i failed,i did eventually appeal and won and i was put back onto esa and in the support group.i have since applied for the the severe disability premium again but this time i habe been turned down and they said it is because my eldest children are 18 but they were 18 when gave it to me before but also i still claim child benefit and child tax credits for them due to them still being in fulltime education.i have read a few posts where their case is the same they were turned down but then was told they could still recive it despite their child being 18.does anyone know if it is possible for me to claim severe disabilty premium as they are classed as dependants not non dependants.thank you

I knew someone who lived with a friend and because they had seperate bedrooms and no communal space ( it was a 1 bedder) they both got that premium, I have no idea if it's changed now tho x
Many thanks to all who contribute on MSE :)
