    It's a legal moot point.

    Owners son could have in reality been the 'landlord' and your son/others, his lodgers. Or the son could have been acting as his parents' agent (collecting rent). The fact that he kept some of the rent though, suggests he was the landlord. His parents were his landlord (and the rent he paid them was different to the rent he collected).

    I assume also he was not named as a joint teant on the tenancy agreement your son signed?

    But as Guest says above, it's all a bit academic, and would only become relevant if there was a legal dispute (who sues who?).

    Yes, HMRC are, I suspect, unaware both of the cash the son is keeping (income) or the cash his parents are receiving (the mortgage payments). Tax fraud I suspect though of course they may all be declaring it........

    As a joint tenant, he should check the property. that includes the other rooms. And photograph them.
