Letting Agent - Deposit Query

England 6mth AST, Now Rolling Monthly

Just handed notice in on the property that I'm in to the LL. The let was arranged by a letting agent. Following a number of frank discussions, my deposit was protected by the letting agent approx 6mths into the tenancy (yes, I know the regulations and potential but I'm not going to cut my nose off to spite my face if I don't have to)

LL has asked me if I've contacted the Letting Agent yet about the deposit? Now my view is that any discussion over it is between landlord and I (as per/like the contract). Do I need to tell the letting agent about my decision to leave the property and request the deposit back/notify them that I'm going.

It's protected through the TDS.

There's really no downside to you by claiming this through the courts

    You have a contract with the landlord. The landlord has a contract with the letting agency. You have no contract with the letting agency.

    As long as you have served notice to the address given in your tenancy agreement for the serving of notices that's it.

    Any check out inventories and deposit returns are the responsibility of the landlord to organise.

    What address is on your tenancy agreement for serving notices? The agents? The landlord's? His mum's? Mine?

    Whatever it is, that's where you serve notice because that's what your contract says.

    You write to the same address requesting your deposit, and/or put in a request to TDS.

    You've given notice to the landlord. Fine.

    Your landlord has asked you if you contacted the letting agent, who seems to be the party holding the deposit.
    What is the problem exactly?
