HELP NEEDED FOR POPLA APPEAL A S Security

Just wondered if anyone is able to help, I need to get an appeal to POPLA by tomorrow (have been on holiday) and my head is spinning a little from all the advice about appeals to POPLA and what to include in the wording depending on which company the PCN has come from. My is A S security for a ticket on my car at a private car park in Perranporth, at no point have I admitted to being the driver, only the registered keeper. I've searched quite a bit but can find no link to a previous AS parking appeal. Any help greatly received. As it turns out I wasn't the driver and my partner miss read the signs and as it said £1 for 1 hour, figured it would be £2 for 2 hours which wasn't the case, hence the ticket! Please help.

    You probably don't need me to tell you that you really do have your work cut out to get this done by tomorrow, but there is an A S Parking POPLA example in the link that Redx has given in the previous post to this one. Use that as your base and adapt to your circumstances, but don't reveal the driver.

    Any appeal to POPLA is better than no appeal at all (but steer clear of mitigating circumstances - like the mistake of £1 for 1 hour, £2 for 2 hours stuff). Get it off via their appeals portal on their website.

    Bear in mind that a POPLA decision is binding on the PPC, but not on you!

    You should have dealt with this much earlier. Have you been on holiday for 28 days?

    Have A S Parking definitely issued you with a valid POPLA code?

    A S Parking (aka Athens Security Services Ltd) left the BPA and joined the IPC on 1/5/15.

    Only tickets issued by them before 1/5/15 can be appealed via POPLA.

    Use the link in NEWBIES post #3 for the POPLA checker in Parking Cowboys if you haven't already done so.

    How did they get your details? AFAIK Perranporth is local council land so "not relevant" unless you gave them the driver details.

    "Not relevant land" doesn't mean they can't apply for keeper details. After all, they were requesting (and getting) keeper details long before keeper liability even existed!

    However, the Perranporth car park is owned by a charity, not the council, so "not relevant land" is irrelevant.

    A letter of complaint to the Charity Commissioners might not be amiss if the PPC is being uncharitable.
    You never know how far you can go until you go too far.
  • there are two car parks, the lower is owned by the charity, the upper by the parish council....from a pepipoo thread about the top car park...

    If you want to contest the parking charge notice you have received you will have to appeal to AS Parking at https://www.as-parking.co.uk there is an appeal’s link on their website.



    With regards to your FOI request:-



    1. Could you please inform me on what basis a motorist could be liable to prosecution (as stated on the ticket) for failing to pay and display? – The statement that you are referring to is pre-printed on the ticket stock by the manufacturer. The Parish Council do not have tickets made specifically for their use, as this would significantly increase the costs of the tickets; and we feel that the funds would be better spent elsewhere. The use of the word ‘may’ enables their use in all settings. The Parish Council do not ‘prosecute’ for failing to Pay & Display. Parking Enforcement is carried out by Athens Security Services Ltd trading as AS Parking under contract law in their own name as the creditor and principle.

    2. Are there any Byelaws or Parking Place Orders applicable to this car park, and if so could you kindly provide a copy thereof or advise where they may be found online? – There are no Parking Place Orders or Byelaws for this car park.
