DFD Being Sneaky

in IVA & DRO
Hi Guys, my first post on here so hello to you all
My wife and I got ourselves into a bit of financial trouble 6 years ago and ended up in an IVA with DFD which ended in December last year. We're still waiting for our completion certificate (Apparently no surprise there) and received a letter today saying they are having a variation meeting tomorrow with the creditors to vary the terms of our IVA due to outstanding PPI. It also states in the letter that they won't issue the certificate because of the PPI. I've spoken to Equity In Finance who deal with the PPI claims who confirm that there is NO outstanding PPI and DFD were informed of this in December! I've spoken to DFD and asked them to withdraw the variation meeting and issue the certificate and they won't as we didn't accept the new terms and conditions that came out last year (Which we weren't legally obglied too). I've made a complaint to the financial ombudsmen as I don't see why firstly they haven't issued the certificate and secondly why they are trying to sneakily push through the terms from last year under false pretences by telling the creditors that there is PPI outstanding!

I'm also approaching the end of mine with DFD, and did not sign the new terms, so been expecting them to be awquard about it. All my PPI was sorted some time ago, so interested to see where you get with this.
It annoys me to think you stick to the original terms and they then want to bend them to suit theirselves when they feel like it. I'm fully prepared to go to ombudsman also if they start being funny...0 -
I had a similar problem. Sent a firm letter to their complaints department in February outlining that I was unhappy that I'd not received my certificate (made my last payment in May 2014) and if they didn't sort it I'd be contacting the Ombudsman. Got quite a wishy washy response but the certificate arrived about two weeks after that. Definitely worth putting an official written complaint in.0

I had an IVA with DFD, but at the 2 yearly review, they increased my payments from £130 to £175.
I told them to do one, and asked to cancel the IVA.
That was back in July 2014, they have refused to cancel the IVA, so I have had to make a complaint.
The also over calculated my income and said I was getting more in benefits then I was actually receiving.
For some reason they are refusing to cancel the IVA at my request, I told them I had been wrongly paying into the IVA and that I qualififed for a DRO.
They are not listening.
I wish I had never gone to them in the first place, I paid £2790 into this IVA and yet they have only paid£158 to my creditors.
All they have done is paid themselves instead of my debts.0 -
Absolutely no point in going to the Financial Ombudsman about DFD - IVAs aren't regulated by the FCA, so the FOS won't be able to do anything.
Instead, you need to complain via the Insolvency Service
