"Best Company to work for"?

Dear all, first time posting and I thought this would be a good place to start in helping me gaining some knowledge in this area.

Until last Friday 19th of June 2015, I worked for one of the Sunday Times "Best Companies to work for". I was with them for around 19 months when I decided due to a lot of reasons I should look for another role. I absolutely love my job and what I do but I felt the environment I was in wasn't the right fit for me whatsoever.

I went for another role closer to home and I got it within a day of being interviewed so I was over the moon, I'm due to start with them sometime this week!

My short story starts on that Friday the 19th, when I decided to hand in my notice letter to my Head of Business. This letter stated I really enjoyed my time at the company but I wanted to move on to better my career. My manager at the time was saddened but happy for me, I thought all was well. She even mentioned what I could do in my notice period to help the company out and help the transition out of the business. About 20 minutes later she (my head of business) came down to my desk and told me that the company wanted me to leave there and then. I asked, what about my 4 week notice period? She then said because I was going to a competitor then it wouldn't be offered to me. I was going to be paid up until the Friday 19th of June and any remaining holiday pay will be worked out when I left. I then was watched like a hawk around my desk...I guess to ensure I didn't take any customers with me to my new role....which I had no interest in doing anyways!! Then she asked me to hand over my company car, fuel card and any keys to the business and I was asked to leave, it made me feel like I did make the right choice given the treatment I was given!

Now the reason I'm posting here, I believe that they have broken the employment act by only paying me up until the 19th of June. I wasn't offered garden leave nor asked to work my notice. I was simply asked to leave there and then, personally I don't think this is right and I'd like to work out what is owed to me. Should this not happen then I am willing to take it to court.

Please can you offer me any help or advise, anything is appreciated!

    You were working there for less than two years so there's probably not much you can do.
    But hasn't it worked out for the best for you if you start your new job this week?
  • Yes it's great as I start my new role but I can't help but think I'm owed my 4 weeks notice plus my half my June wage then plus any holiday or commission I'm owed? I feel like I've been shafted but I don't want to start accusing before I know facts.

  • Check your contract then or whatever resembles it, I've had this happen before in sales yep even at the lowest level so don't take it to heart, it is really not uncommon you are asked to leave immediately, (especially when they know there is a job queue..) just be hopeful you'll be getting a reference?

    I did and I'm fine with leaving early, no issues there but my issue is them saying they will only pay me up until I gave in my notice letter. I just think that is wrong in itself. I should of been offered garden leave and be paid for my notice but that wasn't the case. This isn't stated in the contract nor employment handbook, I've spoken to HR and they said they will investigate but I just wanted to have a bit more string to the bow by posting here if that make sense.

    (1)The notice required to be given by an employer to terminate the contract of employment of a person who has been continuously employed for one month or more—

    (a)is not less than one week’s notice if his period of continuous employment is less than two years,

    I doubt they have broken anything yet considering you have probably not passed a pay date.

    First thing would be to send an email requiring clarification on where you stand, they could have put you on gardening leave without telling you, they could make you take your holiday time during your 4 weeks notice etc.

    Get clarification in writing before accusing them of misgivings.
    Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked

    I read it a couple of times without being sure, but i think it's 'cos you've been there less than 2yrs you're due at least a weeks pay.
    I think what they may mean by 'at least' is, if you've got a written contract to say you're due for 4wks you should get that.
    I know you said it was you giving notice, but if they're not accepting that then it's the company giving you notice.
    That's only my interpretation of it.
