DIY Will Writing Wording

Hi there,
Sorry if this has been answered before, but I haven't had the chance to look through all of the threads.
The situation:
My mother is due to have heart surgery on 29th June 2015. y father had an accident and is in a coma.
Their wills are the bog standard, "If I die, my spouse gets half" kind of thing.
My Mum wants to change hers so that it leaves her half of everything to me and my brother, but with the condition that we allow my dad to live in the house.
Would anyone know how to correctly word this in a DIY will?

Definately not a DIY. See a solicitor.I'm a retired IFA who specialised for many years in Inheritance Tax, Wills and Trusts. I cannot offer advice now, but my comments here and on Legal Beagles as Sam101 are just meant to be helpful. Do ask questions from the Members who are here to help.0

This is not a DIY situation, for a start you need to establish how they own the house tenants in common or joint tenants. If they hold the house as joint tenants then she can't leave you half the house as it would pass directly to your father.0

Yes, the tenure of the house is critical if she wants to leave it to anyone other than her husband, You will have to apply to Land Registry to get this changed.0

Best to consult a solicitor. If you chose one that is relatively local to where your mother is living, the solicitor will probably be willing to visit her for a modest extra fee. Obviously not applicable if she can go herself. You will need to allow some time for the solicitor to prepare the papers.Few people are capable of expressing with equanimity opinions which differ from the prejudices of their social environment. Most people are incapable of forming such opinions.0 -
