Warranty on replaced items

Hi -

Is anyone able to shed any light on why, oh, why, a replaced faulty item does not come with it's own 12 month guarantee?

Example:
I bought an XboxOne. 6 months in and both controllers are faulty.

Microsoft offer that I can return them, and they will send replacements. They state however, that these replacements will carry a 95 day guarantee only, or the remainder of any existing guarantee on the original item, whichever is the longer.

This has always puzzled (for puzzled read: annoyed) me. Why my these two brand new (yes?) controllers are not expected to last 12 months, and so are not guaranteed as such.

I can expect the originals to last 12 months, and the new replacements only 3 months??

Is this correct? And why does consumer law not stipulate that replacement parts/accessories/items come with the same 12 month protection as the original items?

Any light shedding would be appreciated...

    A new warranty/ guarantee would in effect be giving you replacements for life, you could get replacement goods at the end of each period and so on.

    Keep in mind that you do have rights under SoGA if you feel the goods have not lasted a reasonable time (from original purchase).

    There is nothing in consumer law that states any goods must come with 12 months protection (or indeed, any time specific protection at all).

    A warranty is something that is over and above any statutory rights that you have and because of this if one is offered a retailer or manufacturer is at liberty to state how long it will be valid for and how replacement goods are affected.

    None of this has any bearing on your sale of goods act rights but these are between you and the retailer and not the manufacturer. (Unless bought directly from the manufacturer)
    One of these rights is that you should expect goods to last a reasonable time, but this time isn't defined anywhere and it will run from the date of purchase irrespective of whether the goods were replaced at any time.

    Because the item is one and the same, it's not classed as a new item but as the existing item working as the original one should. it may be a different unit in shiny new packaging but it is treated as the same item it replaces. As said above it stops infinite replacements and the misuse this would cause.

    Thanks all for your thoughts.

    But infinite replacement would only be the case if the subsequent replacements were found to be faulty, and therefore should indeed be replaced under warranty in my opinion.. which I guess is kind of my point.

    I gave the Xbox controller as my example, but in fact my issue is really with the Xbox headset.

    I am on headset number 4 I think now, since Christmas. All replacements via Amazon to date, who have now closed my original order to any further refund/replace action, which is why I have now approached Microsoft.

    They seem happy to give me another headset, but as they only seem to last weeks/months at best, I fully expect to require another before the warranty is up.

    But once they give me one that lasts the 95 days beyond the end of warranty date, then I am stuffed.

    This is a VERY sub standard product, and therefore, maybe should be replaced ad-infinitum. Or maybe they should replace the product their end with a fit for purpose alternative?
