Hi,Im really worried about my situation.My IVA has failed due to lack of payments and the Insolvency company running it have put me in court at the end of this month for bankruptcy.
I cant make any further substantial payments,til the end of September,im 40k in debt,ive paid £2k,i dont know what to do and i cant really afford lawyers to represent me in court.
What shall i say to the judge? I dont want to be made bankrupt,im getting myself back on track now and can pay £20k at the end of September.

Can anyone help and advise me what to say in court to the judge?:o

    Don't really know much about IVAs failing - you may get better advise over on the Bankrypcy sub-board though

    Have you had any timings from the court, it could be that it all coincides with the time when you have the money. You can contact any of the debt helplines that Martin has recomended at the top of debt free wanna be for advice.

    Which IVA company are you with? You may find that you can change to a non fee paying one.

  • I dont really want to disclose IVA company,I panicked when I made the agreement,now im worried about having too much contact with them as i'll be charged more in fees.im just concerned what to say to the judge as i cant pay a chunk until the end of September.

    THanks Miss Poppy.My court date is set for the end of the month but i wont get any money to pay off a chunk of the IVA till mid to late September.Im just worried about going into court,scared witless,go to pieces and end up ruined for life due to not saying the right thing.
    im at such a low ebb,its eating me away,i cant make any plans and ive nothing to look forward to,im so sick of it all.

    Running Man - even if they do make you bankrupt then it's not the end of the world - there's a whole host of people over on the bankrupcy forum who are living proof of that.

    See if you can get some advise from CAB or someone as others have suggested - if it wasn't explained to you at the beginning of the IVA that this could happen then the company you're with have done something wrong IMHO.

  • thanks for the support but life is bad enough as it is and i know i wont be able to cope with bankruptcy,it'll be the end of everything.I have very little life at the moment,im on my own and bankruptcy would be the final curtain.
  • Just spoken to CAB,they were excellent and it seems like I should be okay by presenting all documents in court to the judge.
  • Your first port of call should be to contact one of the Debt Charities; see links below. Their services are free; they have no vested interest to serve; their advisors are professionally trained and the advice they give will be objective and in your best interests only. CCCS operate a system of telephone appointments that are designed to be flexible and don’t require you to attend an office based interview. At the CAB you will need to make an appointment with a specialist Financial Advisor; other advisors may not have the specialist knowledge you’ll need.

    If and only if you’re advised that bankruptcy is the most suitable solution to your financial problems then the guys & gals here will help any way they can...it may seem a daunting prospect but bankrupcy is not as bad as some people make out....there are lots of people on the BR & living with it forum who are living proof things work out.. in the end it's YOUR choice..the only way you can be forced into bankrupcy is by a creditor taking action against you...this is usually a last resort & many creditors will see BR as a last resort & will try to at least claw back any money whatever way they can
