Redundancy Advice needed please....

Hi everybody i would much appreciate some help here and advice.

So after 5 years service in my job i am soon to be taking voluntary redundancy with only 2.5 people working in my department and the bosses being scared of the guy that should really be going. I dont want to wait for them to pick me as i feel voluntary looks much better on my cv.

Firstly, In my contract it says the notice period (pay wise) is 4 weeks although the company are offering 3 months which is approx 13 weeks...... Is it possible for the additional 9 weeks there offering to be put through as an en gratia? There is no contractual obligation for them to give this much notice pay so surely is would be passable as a gift of some kind? I would like to find a way to avoide paying tax on it if possible legally?

Secondly how is holiday pay calculated? my understanding is that its your annual allowance (20) days, plus bank holidays, divided by 12, and using that answer to times how many you were entitled to at that point?

secondly on that point.... should i get holiday pay for the time i had accrued during any notice period?

I havent spoken to my employers about this yet and quite frankly i dont totally trust them to be honest about all this and any possible hidden agendas. They have let 2 people take voluntary rendundancy recently and those 2 particular people didnt have a clue and just accepted what they told as being gospel truth.

    Any extra over contractual that is not worked can be paid as part of the package, if you work it it's taxed.

    Holiday accrue upto termination date some companies accrue for any pilon period but don't have to.

    If you have 5 years service your notice is 5 weeks and statutory redundancy is also based on that service.

    Only what can be included in the termination package.

    contractual payments can't be added to the package and paid tax free.
