To update anyone who is interested or anyone who thinks they have all the answers... I have contacted the Ombudsman's office and they've told me I do have grounds to make a complaint and gave me details of who to contact in Aviva.
Following this I have had positive comments from Aviva now they've seen all my documentation,so I would encourage anyone in a similar situation not to take at face value advice given on this forum,please read forum rules and make your own enquiries.0 -

That is the standard answer from the FOS.
Wait to see what Aviva say. They would have to be sole agents for Aviva for them to pay out.
