Act required for Judge to sign TR1

Hi, i am buying a property from a seller (woman)who has the property in joint names. They have been divorced and her husband is no where to be found. Seller was selling the same property last year where she sent the tr1 form to be signed by the judge at that time and was signed by the judge but the buyer didnt proceed with the sale. Now i am buying the property and the seller told me she had send the tr1 form again to the judge, my question is how long will the judge take to sign it, its already been a week, thanks

My solicitor was not dealing with the sale from last buyer. My solicitor spoke to sellers solicitor this week and they said its with the judge n will get signed next week so hoping to exchange contract next week too. but I am not really sure if they are telling the truth here that a judge can sign on someone's behalf because they r not present in just under 2 weeks time. Wat I'm worried is am I looking for a month here to get this tr1 thing sorted out?
The seller solicitor said the process maybe fast because the tr1 form was signed last year by the judge but the buyer walked out. I have no idea if that will help since I m not solicitor neither studied the law0 -
It varies. It will depend on how busy the local court is, and what the terms of the order were that allows the Judge to sign the paperwork last time.
You can ask your solicitor to ask the seller for a copy of the order permitting the Judge to sign - assuming that it is simply stating that the paperwork can be signed by a Judge in place of the ex-husband, then timescale is how quickly they get it to a Judge, and how quickly the court sends it out. That could be days or a couple of weeks, depending on how efficient the court is.
If the order was specific to the previous sale (which it may be, if the price has gone down) then they may need to arrange another short hearing, which will take longer.All posts are my personal opinion, not formal advice Always get proper, professional advice (particularly about anything legal!)0
