We Have Been very Stupid, I am disabled applied for pip for first time got standard rate not quite enough for a car. whilst all this was happening our car died and went to the scrap yard.
No money no car and a husband that comutes, my dad lent us the money for a car.
We put £200 deposit down told it was pending test drive, as it couldn't test drove without a MOT.
We found out days later they had no V5 or any paper work and wanted us to pay for tax and fill in V62 before test drive. When my husband said he wasn't happy about all this, he said he would see what he could do and call back but didn't.
After days of chasing him today he said he has sold the car to some else as they didn't want a V5 and we wont get our deposit back.
We were in such a rush we didn't even think to ask a car dealer if they had the paperwork, now we don't have the money for the car! is there anyway to get it back at all?

So it was the trader who beached the contract by selling to another buyer?
In that case you're entitled to a refund of your deposit.0 -
Yep but he is saying its our fault for being picky over the car having no v5 :-(0

No, you left a deposit to buy the car and wouldn't complete until the car was legal to go on the road. He the chose to sell the car, it's his fault and he should refund.
Unless in some way you communicated to him you were pulling out. Then he should only keep what he lost out on by you pulling out.0
