Being bullied by the council over council tax

Hi all

Sorry if this in the wrong section.

I recieved letter's for council tax payment of £69, I had not been to my home for around 60 days for family reasons, by the time I opened the letters I had another one saying I had been charged an additional £69 for late payment and needed to make the payment immediately.

I called up the council and spoke to an employee, who agreed to take £69 and put a credit on my file for the other £69.

Then around 10 days later I got an email from them, telling me they know about my discussion with their employee, but as per me missing the date for the payment, they will not be crediting me the £69 and i still owe it.

I replied to this email debating the legality of what they were doing. They have ignored this email and sent a further letter now requesting 2* extra £69's.

I am quite happy to meet them in court. However this does not appear to be an option, the letter literally says to pay them or they will come to my house and take my things. I only have a number to call.

What do you advise?

Can you clarify whether £69 is the whole amount or a monthly instalment because to me it sounds like they have asked for further monthly amounts as you have got further behind.

A court hearing for a liability order will not consider anything other than the amount being outstanding - if the amount hasn't been paid and the council have issued the requisite notices then the court have no option but to grant the liability order, they have no remit to consider any mitigating circumstances.

It would appear that you have missed at least one payment and the court summons has been issued on that basis with costs. Which local authority do you come under ?.
I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.
