OP did you have a chance to answer the question I asked in post #3? Did you cancel by writing? Have you kept a copy of that letter/email for your own records?
They cant stop you from cancelling. Even where you have no "right" to cancel (such as where they have committed a fundamental breach of contract) you can still cancel without justification - just it is known as wrongful cancellation and you are liable for their reasonable losses resulting from your breach/wrongful cancellation (which is what the 30 days notice & admin fee are). They still have a duty to mitigate their losses - which they would be failing to do if they refused to cancel your contract and essentially inflated their losses while neglecting to mitigate them.
Personally if i were you I'd be offering to pay it off as fast as possible - even if it meant going without something else for a month.
To put it bluntly, if you actively make an effort to pay it back but are still struggling, a court is less likely to award costs against you (not guaranteed by any means - but they might decide that the business have needlessly taken legal action when you were clearly making an effort to pay it back). You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -
If you can't afford to pay hundred and odd quid in one go I think having a kid might be a bad idea0
