It doesn't very safe or enjoyable, perching on top of a concrete garage roof! Is it designed to be used that way? Is there a wall or rail around it and safe access?0

its a double garage, its quite a big block. Our half has enough room to put a large garden table, 6 chairs etc etc on it0

there is a green wooden fence that separates each of our gardens..
the step upto the garage roof/terrace or block is about 1ft..
it is perfectly safe0 -

When you say the new buyers have seen the problem, what is the problem for them? It is written that they have exclusive use, so why do they need or want a deed of variation?
Even though the 3rd apartment doesn't have a garage, have you checked what info, if any, is on their deed/plans.
I have to say, it is very difficult (for me at least!) to picture a concrete slab that sits on top of a roof. How is it accessed?0 -

I'm guessing it's something like this, but recessed into a hill so there is near ground level access onto it.
