Can anyone help me with this issue.

Hi, about 18 months ago I had my bathroom refitted. I purchased all the items myself and employed a plumber to carry out the works. The problem I have is that the bath I purchased has developed a fault and had de laminated so it would bubble up under the plastic.


I purchased a Phoenix Pensato stage 2 whirlpool bath from QS Supplies. When the fault arose I contacted Phoenix as the bath came with a 25 year warranty. I was told by Phoenix that QS supplier had to complete an online form for them to authorise an operative to inspect. QS Supplies lied and ignored me for 4 months until they finally submitted this.


The Phoenix chap came round and advised that the bath was indeed theirs but the whirlpool system was not therefore the warranty was void.


I purchased the item believing it to be a Phoenix bath with a Phoenix whirlpool system and with a 25 year guarantee as per the description on the website.


QS Supplies have however fitted their own system voiding any warranties.

I contacted QS Supplies who said the bath was still functional and I could keep it and they would issue a full refund and do not offer any further guarantee..


My problem is that I have spent £7,000.00 on a new bathroom, I do not know if the electrics within the bath are even safe and personally a faulty bath even if free I cannot live with. To remove the bath also means that a lot of labour as tiling will have to be removed and reinstated and also all of the other sanitary ware as the bath is on the back wall.


Could someone please advise who I should be contacting and if I am fighting a losing battle.

    What leads you to think the electrics are unsafe ?
  • They have sourced the item themselves and will not provide me with the specification or who installed them.

    Who are 'they'?

    The important thing is: who sold the bath to you?
    Did 'they' sell the bath to you with the whirlpool equipment already fitted?

    Your rights are with/against whoever sold the goods to you.

    Often it can be useful to use a manufacturer's guarantee, but this isn't one of those times.

    Not quite your scenario, but here is a short extract from MSE's Consumer rights guide:
    Know who's responsible

    When returning items, beware shops trying the oldest trick in the book: saying they're not responsible for the shoddy goods and you must call the manufacturer. This is total nonsense!

    If a company fobs you off by saying “go to the maker instead”, it's wrong. It's the retailer's job to sort it.

    It doesn't matter if it's an iPod from a high street shop or a designer frock from a department store. If something's broken, torn, ripped or faulty, the seller has a legal duty to put it right as your contract is with it.
    On re-reading your original post it appears that QS Supplies sold the bath to you.

    It is QS Supplies that you should be seeking a remedy from.

    However, it becomes more difficult now that they have offered a full refund.
  • Yes it is QS Supplies who fitted non Phoenix system. I am advised that it will cost around £1500 for new tiles and fitting plus the £800 for the correct bath. Are QS Supplies in any way liable for these costs I will incur. Thanks for the response.

    I admittedly have expensive taste. But being honest, I'm struggling to see in what circumstances replacing a bath will require £1500 worth of tiles. Or are you planning on having the entire bathroom tiled again?
